Enduring Guardian
An Enduring Guardian is a lifestyle decision document. If because of an accident, illness or disability you are unable to make decisions regarding where you reside, and what medical and dental treatment you should be receiving then the Enduring Guardian is appointed to make those decisions on your behalf.
The document also gives a direction to your Enduring Guardian that under certain medical conditions artificial means such as life support are to be turned off.
Similar to a Enduring Power of Attorney, the document must be executed whilst the person has the capacity to execute it. If the person is incapacitated then a person’s loved ones will have to apply to the Guardianship Board to be appointed however, there are no guarantees that the Guardianship Board will appoint those loved ones.
In a number of circumstances the Guardianship Board may appoint one of their own representatives to act as Guardian. Should you wish to discuss Enduring Guardians please do not hesitate to contact us on 02 4228 5911.
